1. About this agreement
This document sets out the terms under which Ekaterina Konovalenko (“the Photographer”, “I”) provides photography and retouching services to you (“the Client”, “you”). By booking a session, paying a deposit, or attending a shoot, you confirm that you have read and agree to these terms.
2. Services
I offer portrait and small-event photography, document and headshot photography, and professional retouching (beauty, jewellery, product, and creative compositing). The specific service, deliverables, price, and timing are agreed with you before each booking. Document photography is produced to meet Government of Canada / IRCC specifications where applicable.
Document and passport photography follows separate terms set out in Section 13.
3. Booking and deposit
A booking is confirmed once a deposit of $50 CAD is received. The deposit goes toward your session total and reserves your time. The remaining balance is due on the day the session is completed, unless otherwise agreed.
4. Payment
Payment is accepted by Interac e-transfer or cash. For photo sessions, the balance is payable the same day the session is completed. For retouching services, terms are agreed individually and may require payment before files are delivered.
5. Rescheduling and cancellation
If you need to reschedule, please give at least 24 hours' notice and we’ll arrange a new date. The $50 deposit is refundable if you cancel more than 24 hours before the session; within 24 hours, it covers the reserved time. Same-day cancellations and no-shows are charged in full. Once a session has taken place, fees are non-refundable, but I’ll work with you on the edits until you’re satisfied with the result.
I reserve the right to reschedule due to illness, equipment failure, or unsafe weather/conditions; in that case you may choose a new date or a full refund of your deposit.
6. Delivery
A preview of selected images is typically provided within 24 hours, and the full edited gallery within 10 business days, delivered via a cloud link. Rush delivery may be available on request and may carry an additional fee. Files remain available for the cloud-storage period stated in your package; please download and back up your images within that time. (Document photography is delivered same-day — see Section 13.)
7. Editing and final files
You will receive professionally edited images. Editing style is at my creative discretion within the look agreed for your session. I do not provide unedited/RAW camera files. Additional retouching beyond what your package includes can be arranged at my hourly rate.
8. Use of images and your privacy
By attending a session you grant permission for your images to be used in my portfolio (website and social media). If you would prefer your session to remain completely private, let me know in advance and I will not publish your photos anywhere. I will never sell your images to third parties.
I collect only the personal information needed to provide the service (such as your name and contact details) and handle it in line with applicable Alberta privacy law. I do not share it except as required to deliver your service. (Document photography is subject to the stricter confidentiality terms in Section 13.)
9. Copyright
I retain copyright of all images I create. You receive a personal-use licence to print and share your delivered images. Commercial use (advertising, resale, brand campaigns) requires a separate written agreement. Please don’t apply your own filters or heavy edits to delivered images before sharing, as they represent my work.
10. Client conduct and safety
I’m committed to a respectful, comfortable session for everyone. I reserve the right to end a session without refund in cases of unsafe, abusive, or inappropriate behaviour.
11. Limitation of liability
I deliver every project to a professional standard. In the unlikely event of equipment failure, data loss, or other circumstances beyond my control, my total liability is limited to a refund of the fees paid for the affected service.
12. Agreement
Booking a session and paying the deposit confirms your acceptance of these terms.
13. Document & passport photography — special terms
Document photography (passports, PR cards, visas, work permits, IDs, and professional headshots for documents) follows separate terms from artistic sessions:
- Same-day delivery. Your photos are reviewed for compliance and delivered the same day as printed copies, with digital files available on request. The 24-hour preview and 10-business-day gallery timelines do not apply.
- Payment. Payment is due at the time of the session, before photos are handed over.
- Compliance. Photos and prints are produced to meet Government of Canada / IRCC specifications, including correct print size and proportions. Final acceptance rests with the issuing authority; if a photo is rejected for a reason within my control, I will reshoot and reprint it at no charge.
- No rescheduling deposit. Because these are quick, same-day appointments, the $50 deposit and 24-hour cancellation policy do not apply unless otherwise agreed.
- Confidentiality. Document photos contain sensitive personal identification and are treated as strictly confidential. They are never added to my portfolio, website, or social media, never used as examples, and never shared with anyone. I keep your files only as long as needed to deliver your photos, then delete them from my working storage. These images are for your personal and official use only, and no promotional usage rights are granted to me.
